$525,000 Lemon Law Victory

On March 13, 2009, a plaintiff won a $525,000 judgment against auto manufacturer Saleen, Incorporated. Saleen manufactures high performance cars. The award is one of the largest Lemon Law judgments in the history of the California statute’s history.

The lawsuit was brought because of design and manufacturing defects in the plaintiff’s 2005 Saleen S7, twin turbo. The defects prevent the plaintiff from being able to drive the car.

Modern Complexity in Automobiles Lead to More Lemon Law Claims

Lemon law cases are still popular among those who have defective vehicles. Recently, a Victorville, California man was awarded $47,000 plus court costs in a suit against Chrysler. The suit involved a defective 2006 Dodge Ram pickup truck with a transmission problem. The transmission in the truck would not engage for several seconds after the truck was put in reverse. The recovery represents the full purchase price of the truck.

One of the reason Lemon laws remain popular is that the increasing complexity of automobiles has led to an increasing number of defects. However, dealers often use the complexity to try to confuse consumers into believing that any problems are just the way the car works. The result is that the consumer will either delay or fail to bring a claim.

Lemon Law for Puppies?

Massachusetts statutes provide "Lemon laws" for not only cars, but pets as well. The pet statute, like the one for cars, outlines the minimum standard of condition the pet must be in prior to transfer of ownership.

For example, it has minimum levels of health, age, and safety, as well as, assurances tha each puppy or kitten is parasite free.

Moreover, if your new pet does not meet these requirements, you are allowed up to 14 days to return the pooch or kitty and receive a full refund or a replacement.
